Iraq war veteran plans armed march on Washington on July 4

patriotism

A radio host and Iraq war veteran will be leading an armed march on Washington, D.C., this July 4, Independence Day, to put government on notice that we won’t be intimidated.

Adam Kokesh

Adam Kokesh

He is Adam Kokesh, 31, a Libertarian activist and talk radio host. Kokesh was a corporal in the United States Marine Corps Reserve and a veteran of the Iraq War, serving in Falujah in 2004 as a liaison between the U.S. military and Iraqi civilians as a member of the 3rd Civil Affairs Group. He is an outspoken opponent of the U.S. military intervention in Iraq.

On September 2, 2008, Kokesh spoke at Ron Paul’s Rally for the Republic in St. Paul, Minnesota, where he stated, “While it is our responsibility now to resist tyranny civilly, while we still can, there may come a time when we will say to the powers that be, be it with your blood or ours we have come to water the tree of liberty … who will stand with me?”

Gregory Gwyn-Williams Jr. reports for CNSNews, May 5, 2013, that Kokesh launched the planned armed march as a group on Facebook, the “Open Carry March on Washington,” and hopes to get 1,000 supporters to march into the nation’s capital with loaded rifles.

The group plans to meet at 9 a.m., July 4, 2013, at Arlington National Cemetery in Virginia. From there, they will march across the Memorial Bridge into Washington, D.C. and continue down Independence Avenue.

While Virginia permits open carry, Washington, D.C. does not issue any permit/licenses to carry a firearm.

Washington crosses the Delaware

The Facebook page states that the event, though armed, is non-violent and if the group is met with physical resistance, they will turn back:

“This is an act of civil disobedience, not a permitted event. We will march with rifles loaded & slung across our backs to put the government on notice that we will not be intimidated & cower in submission to tyranny.

There’s a remote chance that there will be violence as there has been from government before, and I think it should be clear that if anyone involved in this event is approached respectfully by agents of the state, they will submit to arrest without resisting.”

The event is open to unarmed supporters, journalists and welcomes law enforcement officers to join.

Smart Growth and Stealth Zoning

“The goal of this comprehensive plan is to make sure our city is affordable and competitive. We can make the most efficient use of our tax dollars if we plan carefully instead of letting things happen chaotically.” -American Planning Association

“Human habitation as it is referred to now is restricted to lands within the Urban Growth Boundaries of the city. Only certain building designs are permitted. Rural property is more and more restricted on what uses can be on it.” -Rosa Koire, Behind the Green Mask

In East Tennessee, the UN Agenda 21 Smart Growth plan is the five county local “Regional ” program called Plan East Tennessee (Regional Plan for Livable Communities), a plan which will eliminate private property rights in these five counties. (Link) It is the plan for Smart Growth.

The City of Knoxville applied for a federal grant from Housing and Urban Development (HUD), Office of Sustainable Housing and Communities, while Governor Bill Haslam, a Republican, was Mayor of the City of Knoxville. Link

HaslamTennessee Gov. Bill Haslam (R)

These grants, part of the Obama administration’s Partnership for Sustainable Communities, bring together HUD, Department of Energy, the Department of Transportation, and the Environmental Protection Agency. Two types of grants were awarded — those to update existing plans, and those to develop sustainability plans from scratch.  Knoxville’s Plan ET is from scratch and Knoxville received $4.32 million from the HUD grant.  Another $2.5 million came from a Consortium of partners which includes non-profits.  (As an aside, the Knoxville Utilities Board, KUB, received a $3.6 million grant from DOE, Department of Energy, to install smart meters.)

The Architectural firm, Wallace, Roberts, and Todd, (WRT), headquartered in Philadelphia, Pennsylvania, is the Plan ET partner chosen to head the forums.  They were paid $1.7 million to accomplish the pre-determined outcome of these forums through facilitation of the Delphi Technique.  The Metropolitan Planning Commission (MPC), another unelected commission, has $1,591,000 of the HUD/Plan ET monies in their account as of June 14, 2012.  Another $100,000 was given to the MPC for the costs of the forum locations and refreshments.  This leaves approximately $3.4 million in the City of Knoxville’s coffers, it is believed, since they are the ones who’d applied for the grant.

Governor Haslam has proven he is an EPA, Agenda 21 proponent, not only by allowing the application for the Smart Growth grant from HUD, but by his actions since becoming governor. Haslam has also refused to sign a resolution against Agenda 21, even though a Resolution has absolutely no binding power of law.  Link

In my previous article on NewsWithViews, “Mind Control and Smart Growth,” I explained that Knoxville is also a dues paying member of ICLEI since 2007.  From Tom DeWeese’s article, “Agenda 21 in One Easy Lesson” on ICLEI – Local Governments for Sustainability (formally, International Council for Local Environmental Initiatives): “Communities pay ICLEI dues to provide “local” community plans, software, training, etc. Additional groups include American Planning Association, The Renaissance Planning Group, International City/ County Management Group, aided by US Mayors Conference, National Governors Association, National League of Cities, National Association of County Administrators and many more private organizations and official government agencies. The Foundation and government grants drive the process.”

On Thursday, March 21st, 2013, three of us attended a meeting of the Farragut City Council. About 20 people were in the audience at this meeting. The 2010 Census recorded 20,689 population for Farragut, which is part of Knox County.  Knox County is the largest of the five counties in Plan ET Smart Growth with a population of nearly 500,000.  Total population in the five county “region” of Plan ET is 700,000.  Obviously, very few people in the area go to their council or commission meetings, and this is where the damage is done to our freedoms.

The first person that spoke was Matt Barney, the developer of 52 acres, and he kept expounding on the Green Spaces they were developing, with fruit trees and gardens. He stated his whole development was a “green community.”  According to the zoning laws of the Town of Farragut, 35% of any development now has to be given over to green space.  For this developer, that means 17.74 acres of this 52 acre development.  It was originally 96 home sites, but was reworked to be 49 home sites for more “green space.”

So, developers in the Town of Farragut must give up more than one-third of their property for “green space” rather than building homes on all of the property they’ve purchased.  How would you like to buy a piece of land you intend to use, but then be told by the local politicians that more than one-third of that land cannot be used for the purpose you desire.  Just a little fascism sprinkled in for enjoyment.

Check out Farragut’s Planning Division.  The Division has their own Vision 2025 Smart Growth project, and they’ve already implemented bike lanes in their community.  They even have a Code Enforcement Division that reviews all commercial, office, and residential construction plans, grants permits and sets fees, does inspections and licensing and fees for plumbing/gas and mechanical contractors.  None of this sounds onerous.  However, once Smart Growth is part of the City’s plan, all of this can become draconian in nature. It is happening via zoning and codes by these council and commission members. Remember, this is a very small community of 21,000 people.  Yet, here is Smart Growth, which is in nearly every small town and city in the country.

After the council meeting, there were perhaps a dozen people left.  A presentation by the Knoxville Metropolitan Planning Commission regarding Plan ET was scheduled for the council members.  Three of the ten members left, so the presentation was given to the seven who were left.

Jeff Welch, Knoxville’s Regional Transportation Planning Organization Director, was there along with Metropolitan Planning Commission‘s, GIS (Geographical Information Services) manager, Tim Kuhn, to present the results of the Plan ET Smart Growth project thus far.  (GIS is the mapping of all the counties’ properties.) Tim Kuhn actually used the Delphi Technique on the Town Council members, just as was done at the Plan ET Forums we attended in 2012.  The council members were asked questions about the community, but were provided only multiple choice answers from which to choose. This was to decide what was important to them for their community and how it should “grow” in the next 30 years.  Most of the people on the council will not even be here in 30 years.  During his presentation, Tim Kuhn made the statement that 500 people in this five county “region” had given their “input” at the two series of Plan ET forums regarding what was important to them for their communities in the next 28 years.  So, from a population of 700,000 people, 500 people are deciding our future, without an election, by unelected members of the Metropolitan Planning Commission, and the architectural firm, skilled in the Delphi Technique, (video) who was hired to help them with the predetermined outcome.  Link

At the 2012 series forums, where the “public” was invited, the majority of those present were local government employees who had a vested interest in seeing these Smart Growth plans accomplished.  If those of us against UN Agenda 21 Smart Growth had not attended the forums, the only people giving “community input” would be the invited government shills.  Since they have a vested interest in Smart Growth they shouldn’t have even been voting at these Delphi meetings as it is a conflict of interest!  At one meeting, one of the invitees admitted she was a paid participant.  Of course!  They were all paid to go because they worked for the city, the county, the university, Oak Ridge National Laboratories, etc.

The Farragut Council was then told the results, all of which were scripted for their pre-determined outcome via their use of Rand Corporation’s mind-control Delphi Technique.  RAND developed the Delphi method in the 1950s for the U.S. Department of Defense.  It was originally intended for use as a psychological weapon during the cold war.  Remember, these people from the MPC and Wallace, Roberts, and Todd, also went into schools and used this same “exercise” on children who are not taxpayers!

Kuhn stated the community challenges were, lack of good jobs, highways and side roads needing repair, more public transportation, empty commercial buildings, improved education, protection of natural resources, and drug abuse problems.  He asked the Council members to rate these problems in how the region responds to same.  Kuhn stated the desire was to get people closer to their jobs, more transportation and transit services, more housing for the elderly in urban areas, and to contain “sprawl.”  Instead of population expanding further out in rural communities, he suggested their “results” from the forums stated this needs to be changed.

The entire meeting continued with how the “region” would grow in the next 30 years. Kuhn then discussed the different “regional growth” concepts and went through several different scenarios. He said this is “how we’ll grow and what the range of alternatives will be.”  He explained that these concepts came from the 500 people questioned in the Plan ET forums and then repeated almost word for word what is on the Plan ET website.

1.  The first “Trend concept” is “Business as Usual” – the way East Tennessee been growing for the last 30 years.  Kuhn states this is a “kind of grow out” in suburban areas pattern, following major roads, mostly suburban apartments and suburban single family home neighborhoods, and private vehicles are needed.

2.  The “Spread Out” or “Grow Everywhere” pattern – closer to nature, more rural, embraces that growth can occur everywhere in the “region.”  Growth occurs mainly in suburban and rural areas, with minimal growth in the region’s cities and towns. New development is car-friendly and grows primarily into undeveloped areas. New homes are largely developed in suburban neighborhoods and on rural lots that were once farmland and open space.

3.  Corridors – growing along the regions highways, interstates, and major roads, in more of a linear form, keeping employment in the same areas as shopping, and outside of these areas is suburban housing, different types of subdivisions, and apartments.

4. Centers Concept – The centers concept focuses on growing the region’s cities and towns, as well as creating identity in today’s suburban places by redeveloping aging commercial areas with both businesses, homes and adjacent neighborhoods that are a short walk or bike ride away.  Regional transit connects the centers and local transit is improved.

5. Cities and Towns Concept – Literally using the cities and towns in the regions where most of the growth would occur in a reinvestment and redevelopment of the cities and towns.  Using some of the corridor concept to have more compact shopping, employment, neighborhood development, and other forms of housing which is smaller and within closer proximity to business/shopping/etc.  Also bigger investments in local transit with high frequency transit moving throughout the most populace parts of the region.  Creating an environment that is supportive of a variety of ways of getting around (car, bike, walk and transit).

All the above scenarios sound pretty innocuous, don’t they?  The final plans however, intend the elimination of private vehicles and travel to be only by local transit, bike, or your feet, and you will live in high density housing.  How do they accomplish these goals?  Zoning, annexation (Babelay Farm in Knoxville), codes, taxes, etc. ad nauseum, are all accomplished through your local county commission, and city or town councils.  The local planning commission people are unelected…they are appointed.  In Knoxville, the City appoints seven members and the County appoints 8 members to the Metropolitan Planning Commission.  We cannot get rid of them because they are not elected!

The propaganda campaign to keep us in the dark starts with the American Planning Association (APA). From page 34, of APA’s, “The Planning Commissioner’s Guide,” A number of communities across the country have integrated sustainability into their Comprehensive Plans.  Examples include:

Here are some links to Smart Growth high density housing in Issaquah, WAPasadena, CA;  High Density housing developed by the Puget Sound Cottage Housing Development Zoning Ordinance; Harrison, NJDel Mar, CA; Pasadena, CA; and dozens more.

If you want to stop the takeover of our property, culture and freedoms by the United Nations Agenda 21/Smart Growth/Sustainability, you need information.    Here are important resistance sites and information, and here is a special report on Sustainable Development by the American Policy Center.

How many people are attending their local council and commission meetings?  This is where it all happens people! Are you sitting at home thinking someone else will go and protect your rights?  Are you thinking it won’t happen in your lifetime? It’s here!  It’s happening NOW!  If you want to retain your God given liberties, you’d better get off your fannies and get down to these meetings, and find out what’s going on in your community.  Familiarize yourself!

Like the developer who had to give up 35% of his purchased land for “green space,” how much land are you willing to give up that already belongs to you?  Guess what?!  They’re going to incrementally take all your land, all 100% of it, and it’s happening right now!  Are you ready to give up everything you’ve worked for all your lives? It will be too late when you are marched off to the FEMA camps.  Either you put forth some effort now, just as our founders did then, or you’re just as guilty as the perpetrators.

NOW OBAMA TARGETS YOUR FEDEX, UPS PACKAGES

Shipper warns move ‘has potential to threaten privacy of all customers’

The Obama administration is demanding the nation’s two biggest shipping companies police the contents of Americans’ sealed packages, and a FedEx spokesman is warning that the move “has the potential to threaten the privacy of all customers that send or receive packages.”

Wants your complete cooperation.

Wants your complete cooperation.

FedEx and UPS are in the Justice Department’s cross-hairs for not flagging shipments of illegally prescribed drugs the companies say they had no way of knowing were in their possession.

Criminal charges could be coming against the carriers, even though the government has not alleged any deliberate wrongdoing by the companies.

FedEx spokesman Patrick Fitzgerald said his company has a 40-year history of actively assisting the government crackdown on any criminal conduct, but he told WND this probe was very different from the start.

“What is unusual and really disturbing is it became clear to us along the way that FedEx was being targeted for some level criminal activity as it relates to these medicines that are being shipped from pharmacies, and we find it to be completely absurd because it’s really not our role,” Fitzgerald said. “We have no way of knowing what is legal and not within the packages that we’re picking up and delivering in this situation.”

“At the heart of the investigation are sealed packages that are being sent by, as far as we can tell, licensed pharmacies. These are medicines with legal prescriptions written by licensed physicians. So it’s difficult for us to understand where we would have some role in this. We are a transportation company that picks up and delivers close to 10 million packages every day. They are sealed packages, so we have no way of knowing specifically what’s inside and we have no interest in violating the privacy rights of our customers,” Fitzgerald said.

In addition to the unrealistic expectation that the federal government seems to have for the companies to know what’s in every package, Fitzgerald said protecting the rights of customers is paramount and the issues go hand-in-hand.

Wants to stop illegal shipping of drugs?

Wants to stop
illegal shipping
of drugs?

“They clearly are attempting to put some responsibility for the legality of the contents of these packages. That’s why for us it goes far beyond even just the online pharmacy situation. This really has a chilling effect. It has the potential to threaten the privacy of all customers that send or receive packages via FedEx because the government is assigning a role on us as law enforcement or taking on their role in a way that is not appropriate,” Fitzgerald said.

FedEx sought to diffuse the standoff by offering to stop doing business with any pharmacies that the government suspected to be involved in illegal activities. The Justice Department declined, citing the potential for the pharmacies to sue over a lack of due process.

“If the government were to come to us and give us the name of a customer that’s engaged in some level of illegal activity, we can immediately stop shipping for that customer. We will not tolerate any illegal activity within our networks,” Fitzgerald said. “What we want here is a solution that will apply for the entire industry and serve the public’s interest. That’s why we find it completely absurd and, to a large degree, stunning that the government is not working with us on that solution as they have with other problems in the past. As long as they’re not doing that, there’s really no solution even if they were to pursue an investigation or criminal charges against a specific company. There needs to be an industry-wide solution that will put a stop to this problem.”

That leaves FedEx and UPS with the task of stopping illegal shipments from sources the government will not divulge.

“The comparison that we’ve made is a no-fly list. It’s as if the government were to go to major commercial airlines and accuse them of some level of criminal activity if they were to allow somebody on the no-fly list onto one of their planes without providing them a no-fly list,” Fitzgerald said. “What we want here is the no-fly list for online pharmacies. If they are aware of some level of illegal activity by some number of pharmacies, simply provide us that list and we will stop providing service. It’s a very simple solution.”

Elections have consequences.

Elections have consequences.

Fitzpatrick said no other private carriers are being targeted by the Justice Department, and he has no evidence to suggest this probe is designed to boost the financially strapped U.S. Postal Service at the expense of private competitors.

UPS is currently negotiating a settlement with the government, but FedEx is fighting this all the way.

“Settlement is not an option for us when there’s no illegal activity on our part,” Fitzpatrick said.

Mr. Paul Goes to Washington – Watch Live

mr-smith-goes-to-washington-1

Remember Jimmy Stewart in the Frank Capra classic movie, Mr. Smith Goes to Washington?

Sen. Rand Paul (R-Kentucky) is doing the same thing RIGHT NOW on the Senate floor.

Rand Paul

Sen. Paul is filibustering the POS regime’s appointment of John Brennan as CIA Director because the administration won’t disavow drone killing American citizens on US soil without due process. In fact, the POS’s attorney general Eric Holder three-times refused to answer the question whether it is constitutional for the the United States to use a drone to kill an American citizen on U.S. soil, even if said citizen does not pose an “imminent [national security] threat”.

This is unconstitutional and Sen. Paul said he’s had a enough of unconstitutional actions by this regime and will talk until he can’t do it any more.

Sen. Paul is getting great support from Sens. Mike Lee (R-Utah), John Barrasso (R-Wyoming), and Ted Cruz (R-Texas).

Will any other senators step in when Paul has to quit? Flood your senators’ phone lines with that question.

This is democracy in action, folks!

Sen. Paul and other supporting speakers are also using this occasion to give the American people an excellent crash course on the threats posed to our liberty by the Obama regime’s drones, as well as the fundamentals of the U.S. government as designed by our Founding Fathers — separation of powers into three co-equal branches, the Constitution, the Bill of Rights (especially the Fourth Amendment), and the importance of due process.

NY Congressman wants to ban 3D gun magazines

Remember how, during the heated discussion on FOTM about Feinstein et al.’s gun control/ban legislations, we were saying how we can make our own guns with the new technology of 3D printing?

Guess what.

There’s already a Congressman, Steve Israel (D-NY), who’s seeking to ban that, even though that technology hasn’t even yet become a reality!

Rep. Israel has received:

  • 0% rating from 2nd Amendment groups such as NRA;
  • 100% ratings from pro-abortion groups such as NARAL and Planned Parenthood;
  • 100% rating from the pro LGBT rights Human Rights Campaign;
  • 0% rating from the pro family values Family Research Council.

Steve Israel

J. D. Heyes reports for Natural News, Feb. 13, 2013, that soon after Obama had affixed his signature to 23 executive “actions” tightening existing gun control regulations, and New York Gov. Andrew Cuomo signed into law a raft of harsh new gun control legislation, U.S. Rep. Steve Israel, (D-NY) advanced a proposal to ban futuristic 3D firearms magazines, according to a press release from his office.

Specifically, Israel is calling for a renewal of an “enhanced” Undetectable Firearms Act (UFA), passed in 1988, which would include the 3D magazine ban. The UFA, which bans plastics and plastic guns, is due to expire this year.

Israel said: “Background checks and gun regulations will do little good if criminals can print high-capacity magazines at home. 3D printing is a new technology that shows great promise, but also requires new guidelines. Law enforcement officials should have the power to stop keep homemade high-capacity magazines from proliferating with a Google search.”

According to descriptions of the technology, such magazines can be using 3D printers. From Mashable.com:

Additive manufacturing or 3D printing is a process of making three dimensional solid objects from a digital model. 3D printing is achieved using additive processes, where an object is created by laying down successive layers of material. 3D printing is considered distinct from traditional machining techniques (subtractive processes) which mostly rely on the removal of material by drilling, cutting etc.

The technology is used in the fields of jewelry, footwear, industrial design, architecture, engineering and construction (AEC), automotive, aerospace, dental and medical industries, education, geographic information systems, civil engineering, and many others.

Here’s a video on a 3D gun magazine:

Israel would have you believe that, based on the above video, the mass production of 3D magazines is just around the corner. But nowhere in this video a) are claims that such magazines are durable and capable of rigorous use or longevity; or b) evidence that this “demonstration” was anything more than some kind of stunt.

dictators

Whether or not 3D gun magazines are durable is not the point.

The point is that we have a political class in America whose members are not simply dismissive of our Second Amendment constitutional rights to arm and protect ourselves, but openly hostile to them.

I am reminded of what I once tried to impress on my students — how in the Soviet Union, the Communist Party regime banned the private ownership of typewriters and photocopy machines so as to thwart political dissidents (Refuseniks) from disseminating “dissenting” messages and literature.

We need a Refusenik Movement in America, formerly the Land of the Free.

BIG BROTHER TO MONITOR ‘SOVEREIGN CITIZENS’

New task force to target ‘anti-government extremists’

With almost no media coverage, the White House last week announced its new Interagency Working Group to Counter Online Radicalization to Violence that will target not only Islamic terrorists but so-called violent “sovereign citizens.”

Projection: Psychological projection is the phenomenon whereby one projects one’s own thoughts, motivations, desires, feelings, and so on onto someone else. (Leftists assume conservatives desire insurrection because that is their own desire. You see that every time one of their commentators goes off the reservation and rants about how they would like to kill republicans. ~TD)

The FBI defines “sovereign citizens” as “anti-government extremists who believe that even though they physically reside in this country, they are separate or ‘sovereign’ from the United States.”

(I guess that crowd of polite elderly TEA Party people must have put the wind up these guys. ~TD)

The law enforcement agency noted such citizens believe they don’t have to answer to any government authority, including courts, taxing entities, motor vehicle departments or police.

The FBI warned that sovereign citizens commit murder and physical assault; threaten judges, law enforcement professionals and government personnel; impersonate police officers and diplomats; and engineer various white-collar scams, including mortgage fraud and so-called “redemption” schemes.

(Wait a minute. It sounds like Jesse Jackson and Louis Farrakhan are “sovereign citizens”. ~TD)

The new online working group will be chaired by the national security staff at the White House with input from specialists in countering what the Obama administration calls violent extremism.

Delaware leads nationwide move to strip county sheriffs of power

“If the sheriffs lose their arrest ability then Delaware will be a de facto police state.” -Delaware Sussex County Sheriff Jeff Christopher

Ever wary of tyranny, America’s Founding Fathers took pains to design a political system with many mechanisms to check and balance government power. Those mechanisms include:

  • Dividing government into three co-equal branches (separation of powers);
  • A Constitution that specifies the People as the source of government power, as well as defines and delimits that power;
  • Amendments to the Constitution spelling out the People’s rights and liberties (Bill of Rights) — rights that are by birth (natural rights), instead of conferred by man;
  • Federalism: dividing, decentralizing, and diffusing government power among central (national government in Washington, D.C.) and regional units (the state governments).

sheriff_joeThe fearless Arizona Maricopa County Sheriff Joe Arpaio

The county sheriff plays an important role in American federalism.

According to Wikipedia, the U.S. sheriff is a county official and is typically the top law enforcement officer of a county. Historically, the sheriff was also commander of the militia in that county. Distinctive to law enforcement in the United States, sheriffs are usually elected. Of the 50 U.S. states, 48 have sheriffs. The two that do not are Alaska (which has no counties), and Connecticut (which has no county governments and has state marshals instead of sheriffs).

Most sheriff’s offices have a law enforcement role, and their basic function dates back to the origins of the title in feudal England. Although the authority of the sheriff varies from state to state, a sheriff or his deputies (in all states except Delaware, where the sheriff’s defined role is going through arbitration) has the power to make arrests within his or her own jurisdiction. Many sheriff’s offices also perform other functions such as traffic control and enforcement, accident investigations, and maintenance and transportation of prisoners.

In fact, the office of sheriff is older than the United States, predating the official founding of the U.S.A. by more than a century. As an example, Delaware’s first sheriff took office in 1669 — 107 years before the Declaration of Independence!

In their role as their counties’ chief law enforcement officer, sheriffs answer only to the U. S. Constitution, not to Washington, D.C. That is why liberty-loving Americans, fearful of the growing power of the federal government, look to the sheriffs as a check. Indeed, on the matter of the Obama regime’s gun control and gun ban, more and more county sheriffs are saying “no.”

It should come as no surprise then that the forces of tyranny mean to curtail the powers of the county sheriff, if not abolish the institution altogether. In that nefarious effort, the State of Delaware is leading the way.

In April 2012, Pat Shannan of American Free Press first alerted us to the machinations of Delaware Attorney General Beau Biden, son of VPOS Joe Biden.

Although Delaware’s State Constitution stipulates that the office of the sheriff is a constitutionally created position and sheriffs “shall be conservators of the peace within the counties . . . in which they reside,” Biden sent out mandates to commissioners informing them that their sheriffs no longer have arrest powers. In an opinion released February 24, 2012, State Solicitor L.W. Lewis said that neither the state nor the common law grants arrest powers to the county sheriffs.

Delaware Sussex County Sheriff Jeff Christopher

Delaware Sussex County Sheriff Jeff Christopher

The move to neuter Delaware’s county sheriffs actually began earlier, before Beau Biden became the state’s attorney general. Sussex County Sheriff Jeff Christopher told American Free Press that as far back as 2000, he had noticed a reduction in funding and the chipping away of powers of the office of sheriff. Now, “my deputies and I have been relieved of all arrest powers and can’t even make a traffic stop. Delaware has only three counties. . . The other two sheriffs . . . will not stand up with me”.

As reported by Jack Minor for WND, Democrats in Delaware’s state legislature then sought to legalize Biden’s move with HB 290, a bill to redefine the role of sheriffs: “‘Police officer’ as used in this code shall not include sheriffs and sheriff deputies,” and it “is the intent of the General Assembly to specifically state the sheriffs and their deputies do not have any arrest authority.”

HB 290 redefined the role of sheriffs to where they can serve papers and process administrative work but have no hand in actual law enforcement. Supporters of the legislation said law enforcement authority belongs in the hands of the state police and city police who, unlike the sheriff, are not elected.

Although HB 290 died a quick death when Rep. Danny Short, a Republican who had sponsored the bill, tabled the bill after he realized its true purpose, Democrats introduced a replacement bill.

On May 3, 2012, House Majority Leader Pete Schwartzkopf, a Democrat,  introduced HB 325, which is virtually identical to HB 290, in an apparent attempt to get around Short’s tabling of his bill. As described on the State of Delaware’s website:

“This bill makes the Delaware law clear that the county sheriffs and their deputies do not have arrest authority. Historically the sheriffs and deputies have not exercised arrest authority and the Attorney General’s office has given an opinion that the sheriff’s “power to arrest is no greater than that shared by any citizen.”

Sheriff Christopher said he suspects that Schwartzkopf has been one of the key figures behind the entire legislative process to strip the sheriff’s office of their constitutional power: “He wants to abolish the office of sheriff in Delaware. While he issued a statement saying he isn’t interested in getting rid of the sheriff the truth is he wants to neuter us so the office is under his authority rather than the people who elected us.”

Christopher said if the sheriffs lose their arrest ability then Delaware will be a de facto police state.

On May 10, 2012, Delaware’s House of Representatives passed HB 325 by an overwhelming 36-2 majority. On June 14, 2012, the state Senate passed HB 325 by a 12-3 majority.

On June 19, 2012, Governor Jack A Markell, a Democrat, signed HB 325 into law. (Source: delaware.gov)
