Top IRS official will invoke the Fifth Amendment in congressional hearing about tea party targeting program

• Lois Lerner faces House Committee on Oversight and Government Affairs
• Due to be quizzed about extra levels of scrutiny applied to conservative nonprofit organisations that applied for tax-exempt status
• But her lawyer says she will refuse to answer anything that may incriminate her

The Los Angeles Times reported Tuesday afternoon that Lois Lerner, who heads up the Internal Revenue Service‘s tax-exempt division, plans to invoke the Fifth Amendment to the U.S. Constitution in a hearing Wednesday before the House Committee on Oversight and Government Affairs.

The Fifth Amendment provides that U.S. citizens may not be compelled to offer testimony if telling the truth would incriminate them.

Lerner’s defense lawyer, William W. Taylor III, wrote to the committee on Tuesday that his client would refuse to answer questions related to what she knew about the extra levels of scrutiny applied to conservative nonprofit organizations that applied for tax-exempt status beginning in 2010.

She also will decline to say why she didn’t disclose what she knew to Congress, according to the LA Times.

Lerner ‘has not committed any crime or made any misrepresentation,’ Taylor’s letter read, ‘but under the circumstances she has no choice but to take this course.’

He is asking the oversight committee to excuse Lerner from testifying, claiming that calling her in a congressional hearing would ‘have no purpose other than to embarrass or burden her’ since members would not expect her to answer questions.

Ahmad Ali, a committee spokesman, told MailOnline that ‘Ms. Lerner remains under subpoena from Chairman Issa to appear at tomorrow’s hearing – the Committee has a Constitutional obligation to conduct oversight.’

‘Chairman [Darrel] Issa remains hopeful that she will ultimately decide to testify tomorrow about her knowledge of outrageous IRS targeting of Americans for their political beliefs.’

The IRS applied special criteria to conservative organizations seeking tax-exempt status, putting them on a ‘Be On The Lookout’ (BOLO) list, based on the groups’ names and political philosophies.

President Barack Obama has said he was unaware of the program until May 10, when excerpts of an IRS Inspector General Report on the practice were leaked to reporters.

But Jay Carney, the president’s chief spokesman, confirmed Monday that senior White House staff, including White House Counsel Kathy Ruemmler and Chief of Staff Denis McDonough, knew about the IRS’s habits as early as April 24, and chose not to tell Obama.

The Inspector General report found that Lerner and other IRS were notified in or before June 2011 that some staff in the agency’s Cincinnati, Ohio office were using ‘tea party,’ ‘patriots’ and other key words to add applicants to the BOLO list.

Once on that list, the groups were subjected to additional auditing of their financial practices, their membership and their political activities.

Despite knowing about the program, Lerner and other senior IRS staffers withheld the information from Congress despite receiving several requests from House committees whose members heard from constituents that their tea party groups’ tax-exempt approvals were taking as long as two years to be resolved.

The House Oversight and Government Affairs Committee was among those that specifically asked the IRS whether it was inspecting tea party groups more closely than other applicants, including those on the political left.

Lerner herself launched her agency’s scandal with a planted question-and-answer exchange during a May 10 American Bar Association conference.

Asked the pre-arranged question, Lerner responded by conceding that her employees had acted inappropriately.

‘Instead of referring to the cases as advocacy cases, they actually used case names on this list,’ she told the assembled tax lawyers.

‘They used names like “tea party” or “Patriots,” and they selected cases simply because the applications had those names in the title.That was wrong. That was absolutely incorrect, insensitive, and inappropriate — that’s not how we go about selecting cases for further review.’

She later claimed that the increase in scrutiny of tea party groups was due to an influx of new applications from right-wing organizations, following the Supreme Court’s ‘Citizens United’ ruling, which opened the floodgates to greater political participation by nonprofit advocacy groups.

The Washington Post called that claim bogus, however, with the newspaper’s fact checker awarding it a ‘four Pinocchios’ rating for dishonesty.

Lerner’s boss, acting IRS commissioner Steven Miller, was relieved of his post by Treasury Secretary Jack Lew last week, although the term of his appointment to the job was already scheduled to end in early June.

Other higher-ups inside the IRS have not been publicly held accountable for the improper targeting of conservative organizations.

The Senate Judiciary Committee voted Monday to allow illegal immigrants who get legal status to begin collecting tax-welfare payments, as the panel spent a fourth day working through amendments to the massive immigration bill and party-line splits began to emerge.

In one major change, the committee voted 17-1 to make a third drunken-driving conviction a deportable offense for the newly legalized immigrants if at least one of those offenses occurs after they are approved for legal status.

But immigrant-rights groups called that a rollback of due-process rights for the immigrants and said a drunken-driving incident shouldn’t cost someone a chance at citizenship.

“We cannot and will not support hard-line proposals that take away discretion and limit an individual’s ability to pursue the pathway to citizenship,” said Paromita Shah, associate director of the National Lawyers Guild’s National Immigration Project.

Overall, the committee continued to maintain the delicate balance struck by the “Gang of Eight” senators who negotiated the 867-page bill: Quick legal status for illegal immigrants, but delaying citizenship rights until after the administration spends more money on border security, puts in place a new electronic verification system to check workers’ status, and enacts an entry-exit system to check visas at airports and seaports.

In previous days’ action, two Republican members of the Gang of Eight — Sens. Lindsey Graham of South Carolina and Jeff Flake of Arizona — joined with Democrats to block a series of GOP amendments to stiffen the bill’s security.

But on Monday, the two Republicans sided with their party colleagues on key questions on giving illegal immigrants public benefits.

The 10 Democrats on the committee still outnumber the newly unified Republicans, but the votes signaled tough fights ahead on the Senate floor.

Asked about whether the president entered the Situation Room, Pfeiffer says, “I don’t remember what room the president was in on that night, and that’s a largely irrelevant fact.”

Pfeiffer then argues that Wallace’s questions about the president’s handling of the Benghazi terror attack are “offensive.”

The Internal Revenue Service apologized Friday to conservative political groups for giving their tax documents extra scrutiny — validating the worst fears of Republican activists who have long accused the Obama administration of politicizing the process.

Roughly 75 groups were singled out using words like “tea party” or “patriot” in tax documents, Lois Lerner, who is responsible for overseeing tax-exempt groups, said on a hastily arranged conference call Friday afternoon.

“Mistakes were made initially, but they were in no way due to any political or partisan rationale,” the IRS said in a separate statement.

The announcement is the latest black eye for an agency that has been criticized by members of Congress from both parties, reform groups and conservative activists for its handling of politically active tax-exempt nonprofits.

Senate Minority Leader Mitch McConnell called for President Barack Obama to order a “transparent, government-wide review” to see if similar practices are happening elsewhere in the administration.

House Ways and Means oversight subcommittee Chairman Charles Boustany told POLITICO he will launch an “aggressive” investigation. “We’re not going to let this rest,” the Louisiana Republican said. “We’re going to pursue this vigorously.”

Outside groups on both sides have increasingly chosen to organize as nonprofits — regulated and reviewed by the IRS instead of the Federal Election Commission. Their nonprofit status exempts those groups from paying federal taxes — and unlike super PACs, allows them to hide their donors.

Major outside groups like the Karl Rove-affiliated Crossroads GPS, Koch brothers-backed Americans for Prosperity and the pro-Barack Obama group Priorities USA are organized as 501(c)(4) nonprofits.

The IRS statement said the agency “should have done a better job” dealing with the dramatic influx in applications for 501(c)(4) status. It also said that the decisions on how to handle the applications were made by “local, career employees in Cincinnati.”

“When we see an uptick in applications from a particular type of group…that we don’t ordinarily see, what we do is we centralize those applications into one group to work on them. We do this all the time,” Lerner told reporters. “The problem here was that in some cases they added actual case names to the list. They added ‘tea party’ and ‘patriot’ to the list of cases that should be centralized in this group.”

Lerner said that she only began looking into the issue when the press started writing about it last year before the election. but she declined to say why it took six months for the agency to publicly admit the practice or if any employees involved had been punished.

Lerner added that she was not aware if White House or Treasury Department employees knew about the review before Friday’s apology, and said she did not remember when she notified higher-ups at the IRS.

The White House has not responded to a request for comment.

McConnell said the IRS’s apology wasn’t nearly enough. “Make no mistake, an apology won’t put this issue to rest,” he said. “Now more than ever we need to send a clear message to the Obama administration that the First Amendment is non-negotiable, and that apologies after an election year are not an sufficient response to what we now know took place at the IRS.

“This kind of political thuggery has absolutely no place in our politics,”

He went to his advisors and asked everyone, but none could give him an answer.

Frustrated, Biden went to work in congressional gym and saw Paul Ryan there.

Biden went up to him and asked, “Hey Paul, see if you can answer this question.”

“Shoot Joe.”

Your mother and father have a child and it’s not your brother or your sister.

Who is it?”

Paul Ryan answered,

“That’s easy, it’s me!”

Biden smiled, and said, “Good answer Paul!”

Biden then, went back to speak with President Obama.

“Say, I did some research and I have the answer to that riddle.”

Obama got up, stomped over to Biden, and angrily yelled into his face,

“No! You idiot! It’s Tony Blair!”

(AP) Russia detains 140 suspected Islamic extremists

MOSCOW

Russian police and security agents have detained 140 people at a mosque in Moscow on suspicion of involvement with Islamic extremism.

A statement from the Federal Security Agency reported by Russian news agencies said among those detained in the Friday action were 30 citizens of unspecified foreign countries.

The detentions come a week after the two suspects in the fatal Boston Marathon bombing were identified as originating from the Russian region of Chechnya and sympathizing with Islamic extremists.

There were no immediate reports of charges being filed. The security agency referred The Associated Press to a district office, where the telephone was not answered.

The reports cited the agency as saying the mosque previously has been visited by people who had been involved in preparing or carrying out terrorist attacks.

Clearly the Russian government, no stranger to Islamic terrorism itself, is not encumbered by the self-destructive mental illness that is political correctness, as we seem to be hopelessly afflicted with it here in America.

Even our normally docile neighbors to the north appear to be catching on, and like the Russians, are taking proactive steps to try and protect their citizens from the 7th Century primitives.

Yet here in post 9/11 America, the supposedly most powerful nation the world has ever seen - a place where five Jihadists have successfully reached their targets since January 20th, 2009, the man charged with defending us from our enemies cannot even bring himself to utter the phrase Islamic terrorism.

I hope we will not wind up eating a couple of cities before this nation, and its government, finally wake up to the reality that is Islam.

Big Pharma made $711 bln overcharging seniors and disabled

The 11 largest drug companies have made $711 billion in profits in just a decade, largely due to overcharging Medicare, which does not seek out competitive prices and uses taxpayer funds to support Big Pharma.

Since Medicare is prohibited from purchasing drugs based on their cost, its prescription drug program has been making large payouts to drug companies that have overcharged the program for years, according to an analysis by Health Care for America Now (HCAN).

“There is nothing wrong with a company making profits – that’s what their supposed to do. But the drug industry’s profits are excessive as a result of overcharging American consumers and taxpayers,” writes Ethan Rome, executive director of HCAN, for the Huffington Post. “We pay significantly more than any other country for the exact same drugs.”

Rome notes that per capita drug spending in the US is 40 percent higher than in Canada, 75 percent greater than in Japan, and nearly 300 percent greater than Denmark.

The 11 largest global prescription drug companies have skyrocketed since the Medicare Part D prescription drug program was launched in 2006. The government health program enables seniors and the disabled to buy taxpayer-subsidized coverage for many of the most widely disseminated medicines. But Medicare is prohibited from negotiating prices with pharmaceutical companies or seeking out more cost-effective drugs, thereby costing seniors, the disabled and American taxpayers billions of dollars more than some argue the drugs are worth.

Some lawmakers have recently urged Congress to consider changing the law, for the sake of cutting unnecessarily high costs. Wisconsin Democratic State Senator Jon Erpenbach told Wisconsin Public Radio that his state could save $1.2 billion over ten years if Congress were to allow Medicare to partake in prescription drug negotiations.

“I understand that pharmaceutical companies are for-profit companies,” he told the station last week. “I understand there’s a lot of research and development that goes into the products that they produce. All of that being said, it shouldn’t cost us more to get that kind of pharmaceuticals we need to have.”

But according to the HCAN analysis, Big Pharma spends very little on research and development. Even though pharmaceuticals cite research as a costly part of its operations, the money spent on this is exaggerated, Rome claims. Drug companies spend 19 times more on marketing than on research and development – another reason why the industry reaps so much in profits each year, he adds.

US President Barack Obama has long promised to repeal the prohibition on Medicare negotiations with drug companies, but has so far failed to do so. The Veterans Administration currently negotiates drug prices, and manufacturers argue that letting Medicare take over the negotiations would make no difference to the industry. Supporters of drug manufacturers also continue to emphasize the high costs of research and development.

But the Congressional Budget Office found that if Medicare were to receive the same bulk-purchasing discounts on prescription drugs that state Medicaid programs receive, the federal government would cut its spending by $137 billion over 10 years.

“Our politicians give all kinds of tax breaks and subsidies to big corporations that don’t need them: Big Oil. Wall Street. Companies that ship our jobs overseas,” Rome writes. “Every gift to a special interest, including allowing Big Pharma to overcharge Medicare, is an expenditure of scarce tax dollars. That’s called wasteful spending.”

WASHINGTON, DC – Sources close to the White House have learned that Barack Obama is planning to run for the office of Pope when the College of Cardinals convenes to elect a successor to ailing Benedict XVI at the end of this month. Calling on the promise of Equality for All, Obama is said to firmly believe that the time has come for a non-Catholic to occupy the Vatican‘s highest office.

Foreseeing a looming citizenship issue he states that he has discovered an Italian birth certificate that proves he was born in Rome before he was born in Kenya. “That Hawaiian birth certificate never has been worth what I paid for it anyway,” he noted.

Continuing, he concluded, “And there’s no way that a handful of cardinals could be more expensive to buy than 10 million voters in Michigan.” Further questions should be directed to Obama’s Papal Campaign Manager, Abdul Azeem Khan.

Remembering His Passion

Though strong as an ox, my erstwhile friend, the faux socialist Stephanie, is allergic to work. She would take a temporary job and, when it ends, apply for unemployment benefits. When the benefits run out, she’ll go find another temp job. And so on…. She has diagnosed herself as bipolar and got her therapist to sign her off as “depressive.” No doubt, she now collects Social Security Disability.

Though raised a Christian, Stephanie is a goddess cultist and wiccan witch. She is also rabidly anti-Christian. In a fit of self-pity, she once blurted to me: “Don’t tell me how Jesus had suffered. I’ve suffered more than Jesus!”

This post, “Remembering His Passion,” is for Stephanie, the “artist” Michael D’Antuono who painted the above blasphemous portrait of Obama in 2009, and all malignant narcissists who cheapen His memory by having the gall to compare themselves to Him.

He sweated blood.

After He and his disciples had observed the Passover meal in an upper room in a home in southwest Jerusalem, they traveled to the Mount of Olives, northeast of the city.

There, in the garden of Gethsemane, for 12 hours (from 9 PM Thursday to 9 AM Friday), He prayed. He saw all the sins of humanity — past, present, and future — and knew that the time of His death was near. Suffering great mental anguish, He sweated blood (hematidrosis). As a result of hemorrhage into the sweat glands, His skin became fragile and tender. In the cold night air, His hematidrosis would have produced chills.

He was scourged at least 39 times.

Scourging or flogging was a legal preliminary to every Roman execution. The usual instrument was a short whip (flagellum) with several single or braided leather thongs of variable lengths, in which small iron balls or sharp pieces of sheep bones were tied at intervals. Occasionally, staves also were used.

He was stripped of his clothing, His hands tied to an upright post. His back, buttocks, and legs were flogged either by two soldiers or by one who alternated positions. The scourging was intended to weaken Him to a state just short of collapse or death.

As the Roman soldiers repeatedly struck His back with full force, the iron balls caused deep contusions, and the leather thongs and sheep bones cut into His skin and subcutaneous tissues.Then, as the flogging continued, the lacerations tore into His underlying skeletal muscles and produced quivering ribbons of bleeding flesh. Pain and blood loss set the stage for circulatory shock.

His scalp was pierced with thorns.

The Roman soldiers, amused that this weakened man had claimed to be a king, began to mock Him by placing a robe on his shoulders, a crown of thorns on His head, and a wooden staff as a scepter in His right hand. Next, they spat on Him and struck Him on the head with the wooden staff.

The crown of thorns was not a crown at all. It was probably a bush roughly applied, and tied on with rope.

The thorns probably came from the Lote Tree, a wild bush that still grows freely all over the Holy Land. This bush had thorns between one to two inches long. There are over 70 scalp wounds visible on the Shroud (of Turin).

The soldiers’ beating with the rods to His head covered with this crown would have caused severe bleeding. It is probable that the clump of thorns was removed before His tunic was put back onto His body, and then reapplied during the Crucifixion. The blood trickling down from the newly opened head wounds suggest that the thorns were reapplied before the Crucifixion.

Imagine the pain you’d feel if just one thorn, measuring 1 to 2 inches long, were stuck into your scalp!

He carried his own cross, weighing 125 lb.

The severe scourging, with its intense pain and appreciable blood loss, most probably left Him in a pre-shock state. Moreover, hematidrosis had rendered his skin particularly tender. The physical and mental abuse, as well as the lack of food, water, and sleep, also contributed to His generally weakened state. Therefore, even before the actual crucifixion, His physical condition was at least serious and possibly critical.

It was customary for the condemned man to carry his own cross from the flogging post to the site of crucifixion outside the city walls.

Since the weight of the entire cross was probably well over 300 lb., “only” the crossbar — weighing 75 to 125 lb. – was carried. The patibulum was placed across the nape of His neck and balanced along both shoulders, His outstretched arms tied to the crossbar. The processional to the site of crucifixion was led by a complete Roman military guard, headed by a centurion.

He was nailed to a cross to die

The Romans did not invent crucifixions, but they perfected it as a form of torture and capital punishment designed to produce a slow death with maximum pain and suffering. It was one of the most disgraceful and cruel methods of execution and usually was reserved only for slaves, foreigners, revolutionaries, and the vilest of criminals.

At the site of execution, by law, He was given a bitter drink of wine mixed with myrrh (gall) as a mild analgesic. He was then thrown to the ground on his back, with his arms outstretched along the patibulum.

His hands were nailed to the crossbar at the wrists. The nails were tapered iron spikes approximately 5 to 7 inches long with a square shaft 3/8 in. across.

After both arms were fixed to the crossbar, He and the patibulum, together, were lifted onto the stipes. Next, His feet were nailed to the front of the stipes.

Every breath He took was a struggle, seared with pain.

The weight of His body, pulling down on the outstretched arms and shoulders, fixed the intercostal muscles in an inhalation state and thereby hinder passive exhalation. Accordingly, exhalation was primarily diaphragmatic, and breathing was shallow. This form of respiration would not suffice and hypercarbia soon resulted. The onset of muscle cramps or tetanic contractions, due to fatigue and hypercarbia, further hindered His breathing.

To exhale, He had to lift His body by pushing up on His feet, flexing His elbows and adducting His shoulders. However, this maneuver placed the entire weight of the body on His tarsals, producing searing pain. Furthermore, flexion of His elbows caused rotation of His wrists about the iron nails, causing fiery pain along the damaged median nerves. Lifting of the body also painfully scraped His scourged back against the rough wooden stipes. Muscle cramps and paresthesias of the outstretched and uplifted arms added to the discomfort. As a result, each respiratory effort became agonizing and tiring and led eventually to asphyxia.

After “only” 3 to 6 hours hung on the cross, He breathed his last.

He suffered terribly – unto death – for each one of us.
